LEGAL NOTICE

The Board of Supervisors of Liberty Township, Adams County, PA, intends to adopt the following Ordinances at its meeting on August 1, 2017 at 7:30 p.m. at the Township Building, 39 Topper Rd, Fairfield, PA 17320:

2017-03: AN ORDINANCE OF THE TOWNSHIP OF LIBERTY, ADAMS COUNTY, PENNSYLVANIA, REPEALING ORDINANCE NO. 2-94, ENTITLED AMENDING LIBERTY TOWNSHIP ORDINANCE NO. 3 – 87 WHICH REVISES THE FEE SCHEDULE FOR CERTAIN MUNICIPAL SERVICES OF LIBERTY TOWNSHIP AND ORDINANCE NO. 3-87, ENTITLED ESTABLISHING A FEE SCHEDULE FOR CERTAIN MUNICIPAL SERVICES.

WHEREAS, pursuant to the Second Class Township Code, 53 P.S. 66506, entitled “General Powers”, Board of Supervisors is authorized to make and adopt Ordinances necessary for the proper management, care and control of the Township, and the maintenance of the health and welfare of the Township and its citizens;

WHEREAS, pursuant to the Second Class Township Code, 53 P.S. 66601, the Board of Supervisors may adopt or repeal Ordinances in which general or specific powers of the Township may be exercised, and, by the enactment of subsequent Ordinances, the Board of Supervisors may amend, repeal, or revise existing Ordinances and;

WHEREAS, the Board of Supervisors of Liberty Township ordained and enacted Ordinance No. 2-94, on September 6, 1994, entitled Amending Liberty Township Ordinance No. 3 – 87 Which Revises The Fee Schedule For Certain Municipal Services Of Liberty Township, Adams County, Pennsylvania, be repealed; and;

WHEREAS, the Board of Supervisors of Liberty Township ordained and enacted Ordinance No. 3-87, on November 3, 1987, entitled Establishing a Fee Schedule for Certain Municipal Services, be repealed; and;

WHEREAS, the Board of Supervisors of Liberty Township will now establish fee schedules by Resolution and;

NOW, THEREFORE, BE IT ORDAINED AND ENACTED by the Board of Supervisors of Liberty Township, Adams County, Pennsylvania, and it is hereby ordained and enacted by the authority of the same, to wit:

  1. Ordinance No. 2-94, Entitled Amending Liberty Township Ordinance No. 3 – 87 Which Revises The Fee Schedule For Certain Municipal Services Of Liberty Township And Ordinance No. 3-87, Entitled Establishing A Fee Schedule For Certain Municipal Services are hereby repealed.
  2. This Ordinance shall take effect five days of its enactment.

 

2017-02: AN ORDINANCE AMENDING THE LIBERTY TOWNSHIP ORDINANCE NO 2, 1999 PROHIBITING CERTAIN TRAFFIC AND VEHICULAR CONDUCT IN THE TOWNSHIP OF LIBERTY, ADAMS COUNTY, PENNSYLVANIA

BE IT ENACTED AND ORDAINED by the Board of Supervisors in and for the Township of Liberty, Adams County, Pennsylvania, and it is hereby enacted and ordained by the authority of the same as follows:

SECTION I: ESTABLISHMENT.

This Ordinance amends and reestablishes Ordinance No 2, 1999 Prohibiting Certain Traffic and Vehicular Conduct in The Township of Liberty, Adams County, Pennsylvania.

TEXT AMENDMENT: Purpose of this change is to amend violations and penalties.

Section I

c) Whoever violates any provisions of this chapter shall, upon conviction thereof in a summary proceeding, be fined for a first offense, not less than $100.00 and not more than $1,000.00; for a second offense, be fined not less than $250.00 and not more than $1,000.00; for a third offense, be fined not less than $500.00 and not more than $1,000.00, to be collected as other fines and costs are by law collectible, or imprisoned for not more than thirty (30) days or both. Whoever violates any provision in this chapter for a fourth offense and for any subsequent conviction shall, upon conviction thereof in a summary proceeding, be fined $1,000.00 to be collected as other fines and costs are by law collectible, and be sentenced to a term of imprisonment of not less than five nor more than thirty (30) days. Each day during which a violation occurs shall constitute a separate offense.

The Boyle Road Bridge will be closed for repairs Wednesday, July 5 through Tuesday, July 25.
